Terms of Service

Last updated: 5 September 2026

1. Provider and agreement

Osprey is proprietary software provided by Michel Wijnberg. These terms describe its evaluation and commercial licensing. A written quotation or license agreement accepted by both parties takes precedence where it expressly differs from these terms. Downloading the software does not purchase a subscription.

2. Free evaluation

You may evaluate Osprey with up to 32 devices, with all features and no time limit. This permission is for testing and evaluation, including evaluation on your own network. Ongoing production use requires a paid license, even for 32 devices or fewer.

3. Device count and scope

The device limit applies across one Osprey installation, including all its networks and tenants. Each discovered infrastructure device recorded by Osprey counts, including routers and Layer 2 switches, regardless of discovery method. Osprey recorder and collector probes are excluded. A device represented by one record counts once even when multiple protocols discover it. No software feature is reserved for a paid tier.

4. Paid licenses and subscription terms

Professional and Enterprise licenses permit production use within the agreed scope. The accepted quotation or agreement specifies the licensee, installations, device allowance, term, fees, payment terms, renewal, cancellation and any additional services. Any automatic renewal must be expressly agreed in writing. Professional includes software updates and priority email support during the subscription; Enterprise may add custom service commitments. Contact sales@wijnberg.net before ordering.

5. Limits, expiry and continuity

In Osprey 1.4.1 and later, exceeding the device allowance or reaching paid-license expiry starts a 30-day grace period with full operation. If both apply, the earliest expired grace period determines the restriction. Afterwards, existing devices remain visible and continue updating. New devices can be admitted only within available capacity under the applicable limit; the last valid paid limit is retained after expiry. Evaluation uses a 32-device limit. Restarts do not reset grace periods. This technical continuity does not renew a subscription or extend contractual production rights; arrange renewal or an upgrade when required.

6. License grant and restrictions

Within your evaluation permission or paid agreement, you receive a non-exclusive license to install and use Osprey for your own organization. You may not redistribute, sublicense, resell, transfer the license, remove proprietary notices, or offer Osprey as a hosted or managed service to third parties without written permission. You may not reverse-engineer, decompile or disassemble Osprey except where applicable law permits it. Third-party components remain governed by their own licenses and notices supplied with the software.

7. Support

All users can access the user guide and email support. Support is provided on a best-effort basis. Professional requests receive priority; guaranteed response times, availability, dedicated support or other service levels apply only when expressly agreed in writing. Send technical questions and bug reports to sales@wijnberg.net.

8. Your installation and data

You operate Osprey on your own infrastructure and are responsible for authorized network access, credentials, security, backups and the changes you make to your network. Discovery and simulation results depend on the available observations and configuration; assess them before acting. The Privacy Policy describes website logs, support correspondence and the aggregate usage statistics the software sends.

9. Warranty

Except for express commitments in your accepted agreement and rights that cannot lawfully be excluded, Osprey is supplied as is, without express or implied warranties. Michel Wijnberg does not guarantee uninterrupted or error-free operation, complete visibility of every device, or that simulations predict every real network outcome.

10. Liability

To the extent permitted by applicable law, Michel Wijnberg is not liable for indirect, incidental, special or consequential losses arising from the use of, or inability to use, Osprey. Any additional liability limits must be set out in the accepted agreement. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or overrides mandatory consumer rights.

11. Changes and language

The version of these terms supplied with an accepted order applies for its agreed term. Publishing a revised page does not by itself change an existing paid agreement. Proposed changes for a renewal will be supplied before that renewal is accepted; other changes require agreement or a valid change procedure in the existing contract. English is the reference version; translations are provided for convenience, subject to mandatory law.

12. Contact and disputes

For licensing, cancellation or questions about these terms, email sales@wijnberg.net, addressed to Michel Wijnberg. Please contact us first about a dispute so we can try to resolve it. Any agreed choice of governing law or court is recorded in the written agreement and remains subject to mandatory law.
